Citizens of Ukraine and Belarus can sign an occasional lease, but the standard formalities must be followed. The required documents include:

  • an occasional lease agreement in written form (you can download a template on our blog),
  • the tenant's notarial statement of voluntary submission to enforcement (can be done at any notary office),
  • the indication of a fallback address to which the tenant will move in the event of enforcement (a template is available on our blog),
  • the consent of the owner of that property with a notarially certified signature (you can order this document from us).

If you are missing an address indication for the occasional lease agreement, you can order it from us online — we prepare ready-made documents for further finalization with a notary. If the tenant does not speak Polish, the notary will conduct the process with an interpreter.

An occasional lease is signed in a few simple steps. First, you agree on the lease terms and prepare the agreement in ordinary written form. Then you gather the required occasional lease documents:

  • the owner's consent for the fallback address with a notarially certified signature (at the landlord's request),
  • the tenant's notarial statement of voluntary submission to enforcement (Art. 777 of the Civil Procedure Code),
  • the indication of the address to which the tenant will move in the event of enforcement.

Once the full set is ready, the tenant signs the statement before a notary, the parties sign the lease, and the landlord reports the occasional lease to the tax office within 14 days of the lease start date.

The occasional lease is reported to the tax office by the property owner — within 14 days from the start of the lease, to the office with jurisdiction over the owner's place of residence. The simplest way is to follow these steps:

  • Step 1. Sign the agreement and gather all documents — sign the occasional lease agreement and prepare the full set of required attachments.
  • Step 2. Prepare the tax office notification — include the owner's details, the address of the rented property, the agreement date and the lease start date.
  • Step 3. Submit the notification to the correct tax office — you can submit it on paper or electronically as a general letter.
  • Step 4. Keep proof of submission — if submitted online, save the UPP confirmation; if submitted on paper, ask for a stamped acknowledgment of receipt.
  • Step 5. Observe the 14-day deadline — the most common mistake is counting from the signing date. The law counts 14 days from the start of the lease.

In short: the owner prepares the notification, fills in the property details and lease start date, submits it to their tax office and keeps confirmation. If you order documents from us, once the package is complete all that remains is visiting the notary and reporting the lease to the tax office.
