What is an occasional lease?
An occasional lease is a form of rental agreement that gives the property owner a specific tool in case the tenant refuses to leave after the agreement expires. Unlike a standard lease, eviction based on this type of agreement is significantly faster and less costly — which is why more and more landlords are making it a condition.
The agreement is concluded for a fixed term only, up to a maximum of 10 years. It requires several documents that the tenant gathers before signing — some of which go to the notary.

To sign an occasional lease you need three documents: the lease agreement in written form, the tenant's statement of voluntary submission to enforcement drawn up at a notary (Art. 777 of the Civil Procedure Code), and the indication of a fallback address together with the consent of its owner.
The complete set looks as follows:
- occasional lease agreement — concluded for a fixed term, up to a maximum of 10 years,
- notarial deed of submission to enforcement — the tenant signs this in person at a notary,
- address indication — a document in which the tenant names the property they will move to in the event of eviction,
- statement of the indicated property owner — consent to the tenant moving in, usually with a notarially certified signature.
In practice, the biggest obstacle is not the agreement itself or the notary visit — it is that last point: finding someone who will provide an address and sign the consent. If you do not have someone like that in Poland, you can order the address indication from us — we prepare documents individually and deliver them within 24 hours.
The tenant's statement is a notarial deed in which the tenant voluntarily submits to enforcement under Art. 777 of the Civil Procedure Code. In practice this means that if after the agreement expires they do not vacate voluntarily, the owner can carry out eviction without a lengthy court process — directly on the basis of this deed.
The document must contain:
- tenant's details — first and last name, PESEL or identity document number,
- address of the rented property — exact, matching the lease agreement,
- obligation to vacate — within a specified period after the agreement expires or is terminated,
- fallback address indication — the property the tenant will move to.
The statement must be signed before a notary only — there is no simplified or electronic form. You can download a template free of charge on our blog. The cost of drawing up the deed is borne by the tenant and depends on the rates of the specific notary office.
The owner's statement is a document in which the person holding legal title to the fallback property consents to the tenant moving in — in case they have to leave the rented apartment. It is one of the required elements of an occasional lease, without which the notary will not draw up the enforcement deed.
The document must contain:
- details of the fallback property owner — first and last name and identity document number,
- exact property address — matching the actual state and the land register,
- land register number — which must be verified before use,
- consent to move in — expressed explicitly, with reference to the specific tenant.
The owner's signature should be notarially certified — this is the standard requirement for an occasional lease, though some landlords also accept a handwritten form. It is worth confirming this with the landlord before ordering the document.

We issue the document without a set expiry date. Under the Tenant Rights Protection Act, an occasional lease can be concluded for a maximum of 10 years, so the same time horizon applies to the documents associated with it.
In practice, if after the original agreement expires you renew the lease for the same property and your details have not changed — our document remains valid and you can use it again when signing the next agreement. You do not need to re-order it.
A new document will only be needed if the rented apartment address or the tenant's details change.
